These Terms of Use (hereinafter referred to as the "Terms") govern access to and use of the Companion mobile application (hereinafter referred to as the "App").
By using the App, you confirm that you have read these Terms and the Privacy Policy, and accept them in full. If you do not agree with any provision, please discontinue using the App.
These Terms and the Privacy Policy together form a single agreement between you and the Operator. In case of conflict between these Terms and the Privacy Policy regarding the processing of personal data, the Privacy Policy prevails.
You must be at least 18 years old to register and use the App.
To use the App you must complete registration by providing a valid phone number. You agree to:
You are fully responsible for all actions performed through your account.
An account is personal. Transferring, selling, exchanging or lending your account to third parties is prohibited. Each user may hold only one account; creating additional accounts to evade blocks is prohibited.
The Operator may refuse registration or block an account for breach of these Terms or applicable law.
When using the App, you must not:
You retain the rights to the content you post in the App. By posting content, you grant the Operator a non-exclusive, royalty-free license to store, back up, transmit and display it solely to the extent necessary to operate the App and provide its functionality to you. The Operator is under no obligation to pre-moderate user content.
We are not responsible for user-posted content, but we reserve the right to remove content that violates these Terms.
A meeting thread is kept. Twenty-four hours after the meeting ends, its thread closes to new messages and remains available to the participants for reading only; it is not deleted after any period. The thread and the content posted in it are retained until the service ceases operation. That period limits how long the Operator keeps the data; it is not a warranty of its preservation or availability, and sections 9 (the App is provided "as is", with no warranty of the preservation or availability of data) and 11 (the Operator may discontinue the App) apply. If the contents of a thread matter to you, keep your own copies.
While you are part of a thread, you may at any time delete all of your own content from it - your messages and your files; the files are then permanently removed from storage, while the other participants' content is kept. An individual message can be deleted while the thread is still open to new messages; such a deletion hides the message from the conversation, but the file attached to it stays in storage. The organiser of a meeting may delete any message in its thread, including messages that are not theirs, within the same period and with the same consequences: the message is hidden, and the file attached to it stays in storage.
The thread itself is deleted only together with the meeting, and that happens in three cases: the organiser deletes a meeting that has no joined participants at that moment (nobody joined, or everybody who joined has left); the organiser's account is deleted, whether by them or by the Operator, in which case the meetings they created are deleted together with their threads; or the meeting's marker is removed for breaking these Terms, or its author's account is blocked or deleted by decision of the administration, in which case the meeting is deleted together with its thread (section 8).
The Operator is not a party to the relationships that arise between users. The Operator does not verify the accuracy of information provided by users, does not conduct identity, background or criminal-record checks, and does not control users' conduct.
Any communication, as well as offline meetings, is undertaken at your own discretion and at your own risk. The Operator is not responsible for the actions, conduct or content of other users, or for any harm resulting from interacting with them.
We recommend caution: do not share confidential information with strangers, arrange first meetings in public places, and tell people close to you about your plans.
If another user's content or behavior violates these Terms, you can report the user, message or marker directly in the App, and block the user to stop any interaction. Reports related to child safety are handled as a priority - see the Child Safety Standards page.
The App, including its name, logo, design, source code, graphic and text elements, belongs to the Operator and is protected by intellectual property law. The Operator grants you a limited, non-exclusive, revocable and non-transferable license to use the App for its intended purpose. Copying, distributing or modifying the App, or creating derivative products based on it, without the Operator's permission is prohibited.
The administration reserves the right to moderate content and restrict access for users who violate these Terms. Enforcement measures are applied proportionately to the seriousness of the violation:
Temporary suspension, permanent ban and account deletion are decided by the administration. Such decisions are not taken solely on the basis of automated processing; only warnings and internal notifications to the administration are generated automatically.
The Operator also deletes an account at your own request - that is the exercise of your right, not an enforcement measure. The procedure and its consequences are described in section 9 of the Privacy Policy. Deletion of accounts inactive for a long period is governed by section 11 of these Terms.
What this does to a meeting thread: removing a meeting marker, blocking the account of its author, and deleting that account, delete the meeting itself and its thread with it - along with the messages and files of everyone in that thread, not only those of the offender. The full list of cases in which a thread is deleted is in section 4. That consequence is irreversible: if the account block was temporary and is later lifted, the deleted meetings and their threads are not restored.
The App is provided "as is". The Operator does not warrant uninterrupted, error-free or secure operation of the App, the preservation or availability of data, or that the App will meet your expectations.
To the maximum extent permitted by law, the Operator is not liable for indirect damages, lost profit or data loss, nor for the actions of users or damage arising from the use of or inability to use the App.
Nothing in these Terms limits the Operator's liability to the extent such limitation is not permitted by the consumer-protection legislation of the Russian Federation.
You agree to reimburse the Operator for documented losses and for costs of well-founded claims and demands by third parties arising from your breach of these Terms, the rights of third parties, or the law.
The Operator may at any time suspend or discontinue the App in whole or in part, and may restrict or terminate your access to the App. The Operator may delete accounts that have been inactive for a long period, having notified the user by available means beforehand. These actions do not entail any obligation of the Operator to pay compensation.
The Operator is not liable for failure to perform, or improper performance of, its obligations if caused by force majeure, including failures of communication networks and power supply, actions of third parties, and decisions of public authorities.
We may amend these Terms. The current version is always available in the App and on this page; the date of the last update is shown at the top of the document.
Material changes take effect no earlier than 10 calendar days after the new version is published. Continued use of the App after the changes take effect constitutes your acceptance of the updated Terms. If you do not agree with the new version, stop using the App; you may delete your account in the settings section.
These Terms are governed by the legislation of the Russian Federation.
All disputes shall first be resolved through the pre-court claim procedure. The period for reviewing a claim is 30 days. Failing agreement, the dispute shall be considered by a court at the consumer's place of residence in accordance with Art. 17 of the Law of the Russian Federation on Protection of the Consumers' Rights.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in force.
In addition to these Terms, the rules of the app store from which the App was installed (Google Play, RuStore, AppGallery) apply to its use.
